This position is located in the Legal Division, Supervision, Legislation & Enforcement Branch, Bank Activities & Regional Affairs Section of the Federal Deposit Insurance Corporation. Salary reflects a pay cap for this position of $277,500.
Provides or supervises the provision of legal advice and services within the Region, including training in legal matters where such training is requested by the Regional Director (RD) or Deputy Director (DRD). Acts as principal legal advisor to the RD, DRD, and their Senior Staff representatives, including the supervisors of their Field Offices in the Region. May provide or supervise the provision of legal advice and services to other divisions as appropriate. Oversees the gathering of annual budget data pertaining to the overall operations of legal services provided in the Region, including the periodic review and monitoring of the budget. Supervises the dissemination of and ensures compliance with policy statements and directives of the FDIC Board of Directors and of the Legal Division to attorneys and other personnel, relative to FDIC operations. Supervises preparation of evidence and legal arguments in administrative proceedings before administrative law judges, and prepares and supervises the preparation of briefs and legal memoranda in connection with such proceedings. Supervises the preparation of motions, briefs, and other responses in matters involving the Corporation's supervisory, regulatory, and enforcement authorities and functions. Conducts and supervises the conduct of administrative and investigatory proceedings under the Federal Deposit Insurance Act (FDI Act), as well as other banking laws and regulations, including consumer protection and civil rights laws and regulations, and "prompt corrective action" matters, among others. Also handles or supervises litigation of these matters in state and federal court, as appropriate. Reviews and supervises the review for legal sufficiency of documents submitted in connection with formal applications to the Corporation and other corporate documents, including subordinated capital note and debenture agreements, capital contribution agreements, loan participation agreements, sale and lease-back agreements, trust service agreements, and lease agreements, among others. Confers with attorneys for banks and with bank officials on matters involving the operations and activities of insured institutions located in the Region. Works closely with State bank supervisory officials in the Region in connection with matters arising out of the supervisory functions of the Corporation. Serves as primary counsel to and advises the RD, DRD, and other Regional staff members on the interpretation and enforceability of the FDI Act, the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act), rules and regulations issued thereunder, and other laws applicable to banks. Manages and supervises the activities of a staff of attorneys, paralegals, and administrative/clerical support personnel, providing any necessary instruction, review and counseling for their training and career development, including the preparation and/or review of their performance evaluations. Works in collaboration with the appropriate Human Resources and Legal staff to administer disciplinary action. Hears and resolves grievances or other disputes as appropriate.
