Job Summary

This position is located in the United States Department of Labor (Department or DOL), Employment and Training Administration (ETA), Office of Foreign Labor Certification (OFLC). OFLC provides national leadership and policy guidance to carry out the responsibilities of the Secretary of Labor under the Immigration and Nationality Act (INA).

Key Responsibilities

For Series (0340) - Grade (GS-15): Provides leadership direction and management oversight to the program staff charged with administering the Office of Foreign Labor Certification (OFLC) programs in a manner consistent with the INA, Departmental implementing regulations and applicable policies, and national office guidance.

The position interprets and applies in a fast-paced production environment, the various provisions contained in the Immigration and Nationality Act (INA) as well as a significant body of court and adjudicatory decisions related to administration of either the PERM Program, temporary non-immigration agricultural or nonagricultural programs, or the prevailing wage programs.

Manages and oversees sensitive and complex program issues and makes recommendations to the OFLC Deputy Administrator and/or Administrator for solutions that may include negotiations with stakeholders and/or high-ranking officials to resolve program issues and controversial disputes.

Elicits, as necessary, and to further the objective of sound program administration, support of program officials, customers and other concerned parties and ensures the most effective development, implementation and management of the OFLC programs. Manages and develops program and pandemic materials, standard operation materials and strategic plans designed to verify identified problems or areas of concerns all focused on program enhancement.

Develops and applies new methods and techniques to solve problems where existing guidelines are largely inapplicable or frequently non-existent. The Division Director shall participate, as necessary, in the drafting and management of complex studies of existing, new, and proposed legislation and regulations to determine impact on the area of responsibility. Initiates nondiscriminatory practices in the areas(s) under his or her supervision on the following.

(1) merit promotion of employees and recruitment and hiring applicants; (2) fair treatment of all employees; (3) encouragement and recognition of employee achievements; (4) career development of employees (including minority groups, women and disabled employees; and (5) full use of their skills. The employee is informed of, supports and communicates EEO policy plans and programs to employees.

The employee seeks out and uses available resources, including appropriate personnel generalists/specialists and training resources in performing these responsibilities.
